UK Proposed to Amend Standard References in Support of the Toys (Safety) Regulations 2011

The UK Toys (Safety) Regulations 2011 continuously provides a foundation – even after UK's withdrawal from the EU– for ensuring safe toy products are placed on the market of Great Britain (England and Wales and Scotland) by requiring manufacturers to show how their toys meet the "essential safety requirements".  In the clause 7, Presumption of conformity, of the Regulations, it was described that "conformity with harmonized standards" shall be presumed to comply with the essential safety requirements.

 

List of such references to standards in support of the Toys (Safety) Regulations was previously published on 2021-01-01 (Annex I to Notice 0006/21).  Now then on 2022-08-03, a new notice 0063/22 titled:  "Notice of Proposal to Publish of references to standards for toys in support of the Toys (Safety) Regulations 2011 (S.I. 2011/1881)" was issued, proposing certain amendments to the above-mentioned list of standards.

Notice 1:  The interpretation of clause 7 of the standard should be taken to require that test portions should not be made up of combined materials prior to the migration and analysis stages of the test.

Notice 2:  The limit values in point a) of Table 2 of clause) 4.2 of standard “EN 71-12:2016 Safety of toys — Part 12: N-Nitrosamines and N-nitrosatable substances” are lower than the limit values to be complied with set in point 8 of part III of Annex II to S.I. 2011/1881.  Those values are as follows:

Effective Date:

On 2022-09-01, being the 29th day beginning with the date of this notice, the references to standards will be proposed to be published and accordingly designated under regulation 2A of S.I. 2011/1881 at 00:01, unless this notice is withdrawn or amended before that date.  Any objection to the proposed publication for this purpose may be made to designatedstandards@beis.gov.uk.
